The consumer has the faculty to protect or to publish the present general conditions, being specified than so much the protects that the edition of this document is a matter for his/her/its only responsibility. The set of these information is presented in English language. The consumer declares to have the full legal capacity allowing him to commit to the title of the present general conditions.

Article 1: Entirety
The present general conditions express the entirety of the obligations of all parts. In this sense, the consumer is reputed to accept without reserve the entirety of all arrangements foreseen in the general conditions. No condition general or specific extra in the sent documents or put back by the consumer won't be able to integrate to the present, from the moment these documents would be incompatible with these general conditions.

Article 2: Object
The present general conditions have for object to define the rights and obligations of the parts in the setting of the on line sale of goods and services proposed by the site o-cabot-chic.com to the consumer.

Article 3: Contractual documents
The present contract is formed by the contractual documents following, presented in the following order: the present general conditions; the order form. In case of contradiction between arrangements contained in the documents of different rank, arrangements of the superior rank document will prevail.

Article 4: Confirmation of order
The contractual information will be the subject of a confirmation sent by e-mail at the latest at the time of the delivery or if not, to the address indicated by the consumer within the order form.

Article 5: Proof of the transaction
The computerized registers, kept in the computer systems of the site o-cabot-chic.com in conditions reasonable of security, will be considered as the proof of the communication, the orders and payments intervened between the parties. The storage of the order forms and invoices is done on a reliable and lasting support capable to be produced as proof.

Article 6: Information on the products
o-cabot-chic.com presents on his/her/its web site the products to sell with the necessary features that allow us to respect the article L 111-1 of the Code of the consumption, that plans the possibility for the potential consumer to know before the definitive order all the essential features of the products that he/she/it wishes to buy. The offers presented by o-cabot-chic.com are only valid in the limit of the availablility of stock.

Article 7: Price
The prices are indicated in euros and are only valid to the date of purchase of the product by the consumer. They don't take account of the delivery expenses, invoiced in supplement, and indicated before the validation of the order. The prices take into account the exoneration of the VAT according to the particular conditions of the enterprise as free artist. The payment of the totality of the price must be achieved at the time of the order.

Article 8: Method of payment
To adjust his/her/its order, the consumer arranges, to his/her/its choice, of the set of the methods of payment aimed within the order form. The consumer guarantees to the seller o-cabot-chic.com that he possibly has some authorizations necessary to use the method of payment chosen by him, at the time of the validation of the order form.
o-cabot-chic.com reserves the right to suspend all management of order and all delivery in case of refusal of authorization of payment by bank/credit card on behalf of the officially accredited organisms in case of non payment.
In the case of the product being under delivery by a carrier or colissimo and that the bank emits a refusal of payment thereafter, the customer would be obliged to accept this so-called delivery and to pay by any means in the days that follows.
o-cabot-chic.com reserves the right to refuse to do a delivery or to honor an order emanating from a consumer who has not paid completely or partially a previous order or with which a litigation of payment would be under administration.

Article 9: Availability of the products
The order will be executed at the latest within 7 days from the following day when the consumer placed his order. In case of unavailability of the product ordered, notably because of our suppliers, the consumer will be informed at the earliest moment and will have the possibility to cancel his/her/its order. The consumer will have then the choice to ask either the repayment at the latest in the 30 days of their remittance, or to exchange the product for another type.

Article 10: Modes of delivery
The products are delivered to the address indicated by the consumer on the order form.The consumer is held to verify the state of the packing of the merchandise upon delivery and to inform the carrier of any damages at the time of the delivery, and not after, as well as to o-cabot-chic.com, within one week.
The consumer can, to his/her/its demand, request delivery of an invoice to the address of invoicing and not to the address of delivery. With regard to deliveries, we essentially work with Colissimo Suivi. As soon as we conduct a consignment, you will immediately receive notification.

To reduce to the maximum the expenses of delivery, all products of small or middle size are sent by a service of the post office Colissimo Suivi. Besides being economic, this service delivers in 48H to the whole of France and offer you the possibility to recover the products ordered to your office at drop off points close to the address of delivery in case of absence. If you are absent the day of the delivery, your driver will leave you a delivery note in your mail box, that will allow you to retrieve your packet from the drop off point during the hours of opening, within 15 days. Colissimo Suivi is a very reliable service. However, it can happen, as in all deliveries, happen that their is a delay in delivery or that the product goes missing en route.
In case of delivery delay in relation to the date that we indicated, we ask you to inform us of this delay by calling us by telephone or by sending an email. We will contact the Post office then to start an investigation. An investigation can take up to 21 days from the date of the beginning of the investigation. So during this delay, the product is recovered, it will immediately be re-routed to your domicile (in the majority of the cases). If on the other hand the product is not recovered at the end of the delay of 21 days of investigation, the Post office considers the packet as lost. It is only at this moment that we can send you a replacement product, at our expense.
If any of the products ordered were not available to this moment, we will repay you the amount of the products. If the or the products were still available, but had changed selling price on the site, we would apply the new selling prices, either by repaying you by cheque the difference, or by asking for a complementary cheque covering this gap of price. We decline all responsibility as for the elongation of the delivery times because of the carrier, notably in case of loss of the products or strike.

Article 11: Problems of delivery because of the carrier
Any anomaly concerning the delivery (damage, missing products, damaged packet, broken products.) should be indicated imperatively on delivery day as "handwritten reserves", accompanied by the customer's signature to the delivery driver.
The consumer should confirm this anomaly in the same way by addressing to the carrier in the two (2) following workdays the date of delivery a mail recommended with acknowledgment exposing said complaints. The consumer should transmit copy of this mail by fax or by simple email to: o-cabot-chic.com.
A delivery entirely in conformity with the order won't be able to be refused to the carrier or postman by the customer, in such a case o-cabot-chic.com reserves the right to refuse the repayment, as well as to add the expenses of returning the packet to our warehouse.

Article 12: Return of merchandise
The consumer should inform o-cabot-chic.com on the very day of the delivery or at the latest the first working day following the delivery, all complaints of mistake of delivery and/or non conformity of the products in nature or in quality in relation to the indications appearing on the order form. All complaints received beyond this delay will be rejected.

All complaint not following the definite rules above and in time won't be taken in account and will clear o-cabot-chic.com of all responsibility vis-à-vis the consumer.

Satisfied or repaid :
You have one delay of 7 working days from the receipt to announce us your return.
At the time of a return for solely a total repayment and not an exchange in the context "satisfies repaid" alone either the products are repaid, less delivery charges and restocking. To be accepted, all returns should be signalled beforehand to contact@o-cabot-chic.com.

Article 13: Right of recantation
The consumer has a delay of 7 working days to return, at his/her/its expense, the products not agreeing to him. This delay begins from the day of the delivery of the consumer's order. If the delivery is made on a Saturday, Sunday or bank holiday, it is extended until the first following working day. All returns should be notified beforehand to o-cabot-chic.com :

The product should be returned by Colissimo Recommandé to o-cabot-chic.com.
Only then will the products sent back in their whole and perfect state fit for resale. All products that have been damaged will not be refunded nor exchanged.
Exercising of the right of refunds, the consumer has the choice to ask either for the refund of the item or the exchange of the product. In the case of an exchange, the delivery charges will be met by the consumer.
In case of refunds, o-cabot-chic.com will make all efforts to repay the funds back to the consumer within 15 days. The consumer will be repaid then by recrediting of his/her/its bank account (transaction secured) in case of payment by bank card.

Article 14: Partial non validation
If one or several stipulations of the present general conditions are held as valid or declared such in application of a law, of a regulation or following a definitive decision of a competent jurisdiction, the other stipulations will keep all their strength and their value.

Article 16: Non renunciation
The fact for one of the parts not to take advantage of a default by the other left to one any from the obligations aimed in the present general conditions would know to be interpreted for the future like a renunciation to the obligation in reason.

Article 17: Applicable law
The present general conditions are submitted to the French law. He/it is some thus for the rules of fund as for the rules of shape. In case of litigation or complaint, the consumer will address in priority to o-cabot-chic.com to get an amicable solution.
